Welcome to LOKATE. These Terms of Service ("Terms") govern your use of the LOKATE application and website (the "Service") operated by LOKATE ("we", "our", "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use LOKATE. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate, current information when creating your account.
• You must not share your account with others or create multiple accounts.
• You must notify us immediately of any unauthorised access to your account.
• We may suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Post false, misleading, defamatory, or fraudulent content.
• Harass, threaten, or intimidate other users.
• Post spam, unsolicited advertising, or commercial content unrelated to the community.
• Impersonate another person or entity.
• Post content that is illegal, harmful, or violates the rights of others.
• Attempt to access another user's account or private data.
• Use the Service for any illegal purpose.
• Use automated tools, bots, or scrapers to access the Service.
• Misuse the Safety Check-In feature (e.g. sending false emergency alerts).
• Circumvent security measures or interfere with the Service's operation.

4. User Content

• You retain ownership of content you post (listings, photos, messages, tips, reviews).
• By posting content, you grant LOKATE a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content within the Service.
• You are solely responsible for your content. We do not endorse user-generated content.
• We may remove content that violates these Terms or our community guidelines.
• Marketplace transactions are between users. LOKATE is not a party to any sale and takes no commission.

5. Safety Features

• The Safety Check-In feature is provided as an aid, not a replacement for emergency services.
• Always call 112 (or your local emergency number) in a life-threatening emergency.
• We do not guarantee delivery of safety alerts. SMS delivery depends on your mobile network.
• Misuse of safety features (false alerts) may result in account suspension.
• We are not liable for any harm resulting from reliance on or failure of safety features.

6. Information Accuracy

• LOKATE provides informational content (guides, visa info, emergency contacts, cost of living, transport) for general reference only.
• This information is not professional legal, medical, or financial advice.
• We strive for accuracy but cannot guarantee all information is current or complete.
• Always verify important information (visa requirements, emergency numbers) with official sources.
• Job listings and business directory entries are provided by third parties. We do not verify employer credentials or job legitimacy.

7. Third-Party Services

The Service may contain links to third-party websites and services (Google Maps, AllTrails, transport operators, etc.). We are not responsible for the content, privacy practices, or availability of these services. Use them at your own risk.

8. Intellectual Property

• The LOKATE name, logo, design, and code are owned by LOKATE and protected by intellectual property laws.
• You may not copy, modify, distribute, or create derivative works from our Service without permission.
• Walking route descriptions, guides, and other editorial content are owned by LOKATE.

9. Termination

• You may delete your account at any time from your profile settings or by contacting [email protected].
• We may suspend or terminate your account for violation of these Terms, with or without notice.
• Upon termination, your data will be handled in accordance with our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOKATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR 100 EUR, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold LOKATE harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales. If you are a consumer in the EU, you retain the protection of mandatory consumer laws of your country of residence.

14. App Store Terms

• If you download LOKATE from the Apple App Store, Apple's Licensed Application End User Licence Agreement also applies.
• If you download from Google Play, Google Play's Terms of Service also apply.
• Apple and Google are not responsible for the Service or its content.
• Apple and Google have no obligation to provide maintenance or support for the Service.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use after changes constitutes acceptance.
